TERMS & CONDITIONS

1. Definitions

 

For the purpose of these Terms & Conditions:

 

1.1 “The Programme” refers to The Space Between, a Shifteye Studios Creative Access Programme.

1.2 “The Venue” / “The Space” refers to Shifteye Studios, including any designated areas granted to the participant.

1.3 “The Participant” refers to any individual or team selected for a session.

1.4 “Session” refers to the 4-hour creative access period (inclusive of setup & teardown).

1.5 “Studio Manager” refers to the staff member assigned by Shifteye Studios.

1.6 “Applicant” refers to any person who applies to join the Programme.

2. Purpose of the Programme

 

The Programme provides free, short-duration studio access to emerging creatives for the purpose of developing creative work, hosting small sessions, or advancing early-stage ideas.

It is not a substitute for commercial venue hire.

 

The Venue reserves all rights to select applicants based on internal criteria, including clarity, intent, feasibility, and creative purpose.

3. Use of Space

 

3.1 Participants are granted a limited, revocable licence to use the Space for the sole purpose stated in their application.

3.2 Subletting, ticketed events, or commercial activity without prior approval is prohibited.

3.3 The Space must only be used during the allocated Session time. Additional time is not guaranteed.

3.4 The Venue reserves the right to cancel or refuse access if the Participant’s activity is found to be unsafe, misleading, or misrepresented.

 

 

4. Session Schedule

 

4.1 Sessions are 5 hours in total (including setup & teardown).

4.2 Participants must arrive and leave on time.

4.3 Overtime is not permitted unless explicitly approved in writing.

4.4 Participants must submit a brief session plan 48 hours before the Session.

 

 

5. Equipment & Facilities

 

The following may be provided at no cost, subject to availability:

  • Studio space

  • Up to 50 chairs

  • Bathrooms

  • Kitchenette

  • Limited Wi-Fi

  • Installed PA for ambience

 

Paid add-ons (optional):

 

  • Photography / Videography

  • PA system, microphones

  • Projector

  • Technical support

  • Creative consultation

 

 

6. Conduct & Behaviour

 

6.1 Participants are responsible for maintaining professional and respectful conduct.

6.2 No political, religious, or inappropriate activities are permitted.

6.3 Smoking indoors is strictly prohibited.

6.4 Noise must be kept within reasonable levels.

6.5 The Participant must ensure all guests behave responsibly.

 

 

7. Damages & Liability

 

7.1 Participants are responsible for all damages caused by themselves, guests, or team members.

7.2 Any damage must be reported immediately.

7.3 The Venue will invoice repair or replacement costs, payable within 7 working days.

7.4 The Venue is not responsible for:

 

  • Loss or theft of personal items

  • Equipment left behind

  • Injury caused by Participant's negligence

  • Third-party vendors brought in by the Participant

 

 

8. Media & Content Usage

 

8.1 Participants consent to Shifteye Studios using photography, video, or behind-the-scenes content captured during the Programme for marketing or promotional purposes.

8.2 The Participant must notify all of their guests that media may be captured.

8.3 Participants may promote their session but must tag and credit Shifteye Studios appropriately.

 

 

9. Safety & Compliance

 

Participants must:

 

  • Adhere to all safety rules

  • Use equipment safely

  • Keep pathways clear

  • Follow staff instructions

  • Ensure any brought-in equipment is safe, fire-compliant, and pre-approved

 

 

10. Cancellation

 

The Venue may cancel a Session at its discretion for reasons including:

 

  • Safety concerns

  • Misrepresentation in the application

  • Misuse of the Space

  • Unreasonable behaviour

 

No compensation is provided for Programme Sessions.

 

 

11. Indemnification

 

The Participant indemnifies and holds harmless Shifteye Limited from any claims, damages, injuries, losses, or liabilities arising from the Participant’s use of the Space.

 

 

12. Governing Law

 

This Programme and its Terms are governed by the laws of the Republic of Kenya.
